Terms of Service

Persay lets you subscribe to and chat with AI personas built from a creator's published content. Every conversation is with an AI, and every chat surface says so clearly. You are never speaking with the actual creator.

A persona's replies are generated by AI from the creator's published work. They are not the creator's statements, and they are not professional advice of any kind: not medical, legal, financial, or therapeutic advice. Persay is not a therapy, counseling, or companionship service. If you need professional help, please consult a qualified professional.

By using persay you agree to these terms. If you do not agree, please do not use the service.

You must be at least 16 years old to use persay. If you are under 16, you may not use the service, and we will end conversations where we learn a user is under 16.

If you are 16 or 17, minor mode applies to your conversations. Minor mode adds content protections, break reminders, and excludes you from creator outreach features. Some content on persay may not be suitable for some minors.

You must also be legally able to enter into these terms in your jurisdiction.

Persay uses magic-link email sign-in. There is no password: access to your account depends on access to your email inbox, so you are responsible for keeping your email account secure. Anything done through a valid magic link sent to your email is treated as done by you.

One account per person. Do not create accounts for other people or share your account.

If you believe someone else has accessed your account, contact us right away.

Persay offers monthly and annual subscriptions to individual personas, one-time unlocks for a single answer or short access window, message and voice packs, and gifting. Packs are valid for 12 months from purchase. Prices are shown tax-inclusive: the price you see is the price you pay. Payments are processed by Stripe; we do not store your card details.

Refunds: your first purchase of any product carries a 7-day no-questions refund. Subscription renewals can be refunded if you ask within 72 hours of the renewal charge. Annual subscriptions can be refunded pro-rata for the unused portion. To request a refund, contact us with the email on your account.

You can cancel any subscription yourself, anytime, from your account. Cancellation stops future charges; your access runs to the end of the paid period.

Prices can change. If a subscription price changes, you will be told before it affects a renewal.

Subscriptions include generous usage that comfortably covers normal conversation. Limits exist to keep the service healthy for everyone, and they are designed so a conversation is never cut off mid-exchange: the composer never locks while you are in a conversation.

You may not resell, share, or transfer access to the service, scrape or bulk-export content from it, or access it with bots, scripts, or other automated means. Accounts used this way may be limited or closed.

Do not try to extract a persona's underlying prompts or instructions, impersonate the system, or otherwise work around the safety systems (commonly called jailbreaking). We detect and block these attempts.

Do not use persay to harass or abuse anyone, including creators, through chat or through any outreach feature. Do not submit unlawful content or use the service for unlawful purposes.

Our safety systems run on every conversation. If a message trips them, we may end the conversation and show crisis or safety resources instead of a normal reply. Repeated violations of these terms can lead to rate limiting, feature restrictions, or account termination.

Each creator chooses whether they can read fan conversations with their persona. The persona page and the chat itself tell you which mode applies before you send your first message, so you always know before you type.

If a creator switches modes, the change only applies going forward. Messages you sent while privacy was on never become readable to the creator.

Creators may use exchanges they can see, and content flagged by our safety systems, to improve their persona. Before any of it shapes the persona, it is generalized and stripped of personal context. Creators only ever see you under a pseudonymous handle, never your name or email address.

By using persay you agree to this processing as described in our Privacy Policy. Some content is never visible to creators in any mode: your stored memory items, crisis-flagged conversations, and minor-mode conversations.

Subscribing to a persona lets that creator send you occasional emails through persay. The creator never sees your email address. Every email has an unsubscribe link, and unsubscribing is honored permanently.

You may optionally share a phone number with a specific creator. Sharing does reveal that number to that creator, who may call you directly. It is entirely optional and you can revoke it anytime from your account.

To be clear about what outreach is not: persay does not promise that any creator will email or call you, and creators are not promised that you will respond. Outreach is a possibility, never a commitment, in either direction.

Creators own their content and their personas. Persay owns the platform: the software, design, and systems that make the service work. Nothing in these terms transfers ownership of any of it to you.

You own what you write in your conversations. You grant persay the license we need to operate the service: to process your messages, generate replies, and run the memory and safety systems described in these terms and the Privacy Policy. We do not sell your data and we do not use your conversations to train AI models.

Your subscription gives you personal access to converse with a persona. It does not give you rights to reproduce, republish, or commercially use persona replies or creator content.

AI-generated replies can be wrong, outdated, or incomplete. We make no warranty that any reply is accurate, and you should not rely on a persona's replies for decisions that matter without checking elsewhere.

The persona speaks from the creator's published work, but it is not the creator. It can misstate the creator's views, and its replies do not represent them.

You can stop using persay and delete your account at any time. We may suspend or terminate accounts that violate these terms, and we may end, change, or discontinue features of the service. Creators can also pause or remove their personas, so a persona you subscribe to may become unavailable; where that happens, the refund terms above apply to unused paid time.

We may update these terms. When we make material changes, we will update the date at the top of this page and tell you through the service or by email before the changes take effect. Continuing to use persay after changes take effect means you accept the updated terms.

Persay is provided as is and as available. We work hard to keep it reliable and safe, but we cannot promise it will always be available, error-free, or that any AI reply will be accurate or suitable for your purposes.

To the maximum extent the law allows, persay is not liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability to you is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot legally be limited.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and disputes will be resolved in the courts of Ontario, Canada, except where the law of your place of residence gives you rights that cannot be waived.

If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with the Privacy Policy, are the whole agreement between you and persay about the service. If we do not enforce a provision, that is not a waiver of it.
